PLEASE READ THIS DOCUMENT CAREFULLY BEFORE BOOKING OR PARTICIPATING IN ANY EVENT. BY CHECKING THE ACCEPTANCE BOX OR CONTINUING WITH A BOOKING ON THE PLATFORM, YOU ARE AGREEING TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE PLATFORM.
1. ACKNOWLEDGMENT AND EXPRESS ASSUMPTION OF RISKS
1.1 Inherent Hazards of Adventure Activities: You acknowledge that participating in outdoor adventure experiences, guided trips, and sports activities offered by independent Providers through the Platform - including but not limited to mountaineering, trekking, whitewater rafting, kayaking, rock climbing, scuba diving, paragliding, mountain biking, skiing, and wildlife safaris (collectively, "Events") - involves inherent and unpredictable risks.
1.2 Scope of Risks: These risks include, but are not limited to:
- Extreme weather changes, avalanche, rockfall, lightning, high altitude, and hypothermia;
- Remote operating locations with delayed access to professional medical care or emergency evacuation services;
- Terrain hazards, river currents, steep drops, and equipment failure or misuse;
- Physical exertion, dehydration, heatstroke, or aggravation of pre-existing medical conditions;
- Encounters with dangerous wildlife or natural forces;
- Negligence or errors in judgment by third-party Providers, guides, or other participants.
1.3 Voluntary Participation: You confirm that your participation in any Event is completely voluntary, and you explicitly, freely, and knowingly assume all risks of physical injury, illness, permanent disability, death, or property loss associated with the Event, whether caused by the inherent nature of the activity or by the acts or omissions of any party involved.
2. HEALTH, PHYSICAL FITNESS, AND SAFETY OBLIGATIONS
2.1 Personal Health Declaration: You represent and warrant that you and any person for whom you are booking (e.g. spouse, friends, etc.) are in good health, physically fit, and possess the necessary technical skills, stamina, and mental capacity required to safely participate in the booked Event as described in the listing.
2.2 Medical Conditions & Disclosures: You are solely responsible for consulting a qualified healthcare professional prior to booking high-risk activities. You must inform the Event Provider prior to departure of any medical condition, severe allergy, chronic illness, or physical limitation that may affect your safety or the safety of others during the Event.
2.3 Compliance with Safety Instructions: You agree to strictly follow all safety rules, protocols, equipment directives, and instructions provided by the Provider and its designated guides. The Provider reserves the absolute right to restrict or terminate your participation at any time without refund if your conduct threatens the safety of yourself or others.
3. MANDATORY PERSONAL TRAVEL & MEDICAL INSURANCE
3.1 Insurance Requirement: Because the Platform and Event Providers do not provide personal insurance coverage, you are strongly advised - and where required by a Provider or local regulation, mandatorily required - to purchase comprehensive personal travel and medical insurance prior to participating in any Event.
3.2 Coverage Scope: Your insurance policy should specifically cover:
- High-risk outdoor/adventure sports activities matching your booked Event;
- Emergency medical treatment and hospital stays;
- Search and rescue operations and emergency air/ground evacuation;
- Trip cancellation, delay, or interruption.
4. WAIVER, RELEASE OF LIABILITY, AND INDEMNIFICATION
4.1 Release of Platform Liability: To the maximum extent permitted under applicable law, you hereby release, waive, discharge, and hold harmless the Company, its parent entities, subsidiaries, officers, directors, employees, agents, and platform operators (collectively, the "Released Parties") from any and all claims, demands, causes of action, liabilities, costs, or expenses (including legal fees) arising out of or related to:
- Personal injury, illness, permanent disability, or death sustained by you or any minor in your care during or as a result of an Event;
- Loss, damage, or theft of personal property during an Event;
- The acts, omissions, safety standards, or negligence of independent third-party Providers or their guides.
4.2 Participant Indemnification: You agree to defend, indemnify, and hold harmless the Company and its staff from any third-party claims, liabilities, or expenses resulting from your intentional misconduct, gross negligence, or breach of safety protocols during an Event.
5. SEVERABILITY AND GOVERNING LAW
5.1 Severability: If any provision or portion of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
5.2 Governing Law & Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Ireland, matching the parent corporate entity), and any legal dispute arising from this Waiver shall be subject to the exclusive jurisdiction of its courts.
6. ELECTRONIC ACKNOWLEDGMENT AND CONSENT
By checking the "I agree to the Terms of Service, Cancellation Policy, and Liability Waiver" box during the checkout process, you acknowledge that you have read, understood, and voluntarily agreed to all terms of this Liability Waiver & Assumption of Risk Agreement.
